HockeyStick AI Terms of Use
These terms cover use of the HockeyStick AI platform and, in particular, its Zoom integration: permitted use, third-party dependencies, availability, termination and liability.
1. Provider and agreement
HockeyStick AI is provided by Hockey Stick Advisory Pty Ltd (ABN 60 659 210 894), of Level 2/696 Bourke Street, Melbourne VIC 3000, Australia ("HockeyStick", "we", "us"). By using HockeyStick AI or authorizing its Zoom integration, you agree to these terms and any signed customer agreement. If a signed agreement conflicts, the signed agreement controls to the extent of the conflict.
2. The service
HockeyStick AI helps customers plan and operate partnership programs. The Zoom integration can provision and verify Webinars, enrol people from a HockeyStick-hosted page and reconcile post-event attendance. You remain responsible for your Zoom account, Webinar licence, content, participants and configuration.
3. Accounts and authorization
- Provide accurate account information and protect your HockeyStick and Zoom credentials.
- Only an authorized, designated integration contact may connect or disconnect Zoom for an engagement.
- You must have authority to grant the requested Zoom permissions and to submit Webinar or registrant data.
- You must obtain any notices, permissions and consents required for participant registration, attendance measurement and communications.
4. Acceptable use
You must not use HockeyStick AI to break the law, infringe rights, send deceptive or unsolicited communications, introduce malicious code, probe or bypass security, disrupt the service, access another customer's data, reverse engineer protected parts, or use Zoom data inconsistently with the notice and consent provided to participants.
5. Data and privacy
You retain rights in data you submit and grant HockeyStick the limited rights needed to host, process and transmit it to provide, secure and support the service. Our privacy policy explains the data flows, protection, retention and deletion.
6. Zoom and other third-party services
Zoom is a separate service governed by Zoom's terms, privacy practices, licences and availability. HockeyStick does not control Zoom's approval rules, APIs or outages. Features that depend on Zoom may be unavailable or change when Zoom changes its service, permissions or account requirements.
7. Availability and changes
We aim for a reliable service but do not promise uninterrupted or error-free availability. We may maintain, secure, change, suspend or discontinue features, using reasonable care to avoid unnecessary disruption and, where practical, giving notice of material changes.
8. Intellectual property
HockeyStick and its licensors retain rights in HockeyStick AI, its software, designs, methods, documentation and trademarks. These terms grant a limited, non-exclusive, non-transferable right to use the service during your authorized subscription or engagement; they do not transfer ownership.
9. Suspension, termination and removal
You may disconnect Zoom at any time or remove HockeyStick AI in Zoom. We may suspend or terminate access for material breach, unlawful or unsafe use, non-payment under a customer agreement, or a threat to the service or another person. On termination, access ends and data is handled under the customer agreement and privacy policy; legal, security and audit records may be retained where required.
10. Warranties and liability
Nothing in these terms excludes a right, guarantee or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. To the extent permitted by law, HockeyStick excludes implied warranties and is not liable for indirect, incidental, special or consequential loss, loss of profits, revenue, goodwill or data, or loss caused by Zoom or another third-party service.
To the extent permitted by law, HockeyStick's aggregate liability arising from the service is limited to the fees paid for the affected HockeyStick AI service during the 12 months before the event giving rise to the claim. This limitation does not apply where liability cannot lawfully be limited.
11. Governing law
These terms are governed by the laws applicable in Victoria, Australia. The parties submit to the courts of Victoria and courts entitled to hear appeals from them, subject to any mandatory law that applies elsewhere.
12. Contact and changes
Questions can be sent through the support route. We may update these terms by publishing a revised version and changing the updated date. Material changes apply prospectively unless law or a signed agreement requires otherwise.
